Daily fantasy sports vs. online pick ’em sites
It’s worth starting by differentiating daily fantasy sports sites like FanDuel and pick ’em sites like PrizePicks.
DFS sites allow you to build a team of athletes across a single game or a range of events. Your lineup scores points based on their real-world performance, competes against other teams around the world, and can win cash prizes if your chosen players perform well.
States such as New York and Michigan have moved to restrict pick ’em sites that offer Over/Under style bets that mimic traditional sports betting. In 2023, Maine explicitly banned pick ’em-style fantasy games, with Underdog fined $400,000.
Pick ’em brands argue they are no different from DFS. However, some regulators argue that pick ’em games amount to props — legal only at licensed sportsbooks.
At a glance: Daily fantasy sports & pick ’em sites in the USA
The biggest DFS apps, like DraftKings, are legal or tolerated in most U.S. states. Even California, whose attorney general called daily fantasy sports “illegal” last year, continues to allow DFS apps to operate.
Several states that have mature regulated gambling markets, such as Connecticut, have banned pick ’em sites.
Elsewhere, states with legalized DFS platforms, such as Alabama, impose restrictions on specific pick ’em markets. PrizePicks and Underdog mainly prohibit player props from their apps in Alabama.
Florida is also among a host of states that have sent “cease-and-desist” letters to pick ’em sites like Underdog Fantasy. These platforms have modified their markets to stay on the right side of lawmakers. In 2023, PrizePicks, one of the big pick ’em fantasy sites, issued a strong rebuke to Florida regulators over the clampdown.
